Terms & Conditions

These Terms may be amended at any time without prior notice.

By accessing this website, applying for or purchasing a certification, or using any Premium Water Certified™ badge, logo, designation, material, or brand asset (collectively, the “PWC Assets”), you agree to be legally bound by these Terms & Conditions (“Terms”).

These Terms apply worldwide, to any natural person or legal entity, regardless of jurisdiction.

1. Definitions

PWC
Premium Water Certified™, including its owner(s), legal entity(ies), affiliates, licensors, successors, officers, contractors, and authorized representatives.

PWC Assets
All trademarks, certification marks, badges, logos, names, visuals, documents, templates, texts, files, certificates, and promotional materials owned or controlled by PWC.

Certified Property
A specific property, address, or publicly marketed listing officially approved and registered by PWC.

Approved Systems
The Enagic® K8 Water Ionizer, Anespa DX Shower System, and/or any other water system explicitly approved in writing by PWC.

Certification Fee
The one-time fee charged per Certified Property, unless explicitly granted complimentary certification.

Distributor
Any independent party promoting or selling Approved Systems and/or introducing clients to PWC.

2. Intellectual Property & Ownership

2.1 All intellectual-property rights in the PWC name, certification mark, logos, badges, designs, texts, and materials remain the exclusive property of PWC.

2.2 No ownership, trademark right, or intellectual-property interest is transferred by certification or use of any PWC Asset.

2.3 PWC grants Certified Properties a limited, revocable, non-exclusive, non-transferable, non-sublicensable licenseto display the assigned badge solely for the approved property and purpose.

2.4 Any alteration, reproduction, distribution, sublicensing, resale, or unauthorized sharing of PWC Assets is strictly prohibited.

3. Certification Terms (Property Owners & Operators)

3.1 Eligibility

Certification requires:

  • Installation of at least one functional Approved System

  • Submission of accurate and complete verification materials

  • Payment of the applicable Certification Fee (unless complimentary)

PWC may accept or reject any application at its sole discretion.

3.2 Scope of Certification

Certification includes:

  • A personalized digital certification badge

  • Conditional permission to use approved marketing materials

  • Optional listing on official PWC platforms

No additional rights are implied.

3.3 Property-Specific License

Certification is granted per address or public listing.
Badges may not be reused, reassigned, or applied to other locations.

3.4 Multi-Unit & Resort Rule

One certification may cover multiple units only if:

  • They operate under one brand

  • They are marketed as one unified property

  • They share the same physical location

Separate addresses, listings, or brand identities require separate certification.

3.5 Owner Responsibilities

Certified Properties must:

  • Maintain Approved Systems

  • Comply with all local laws and advertising regulations

  • Use PWC Assets truthfully and accurately

PWC is a private certification and marketing label, not a governmental, medical, or regulatory authority.

4. Distributor & Representative Terms

4.1 Distributors act as independent contractors, not agents or employees of PWC.

4.2 Use of PWC materials requires explicit authorization and may only occur for legitimate certification-related purposes.

4.3 Distributors may not:

  • Advertise properties as “Certified” prior to approval

  • Make medical, health, or regulatory claims

  • Alter or distribute badge files

  • Misrepresent certification scope

4.4 Any future commission or affiliate arrangement requires a separate written agreement. No rights accrue by default.

5. Unauthorized Use & Fraudulent Representation

Any unauthorized public use of PWC Assets constitutes fraudulent representation, trademark infringement, and unfair competition.

This includes (without limitation):

  • Copying badges from PWC channels

  • Using badges on non-certified properties

  • Displaying certification without approval or after revocation

6. Health, Safety & Legal Disclaimer

PWC makes no medical, therapeutic, or health claims.

Certification does not guarantee water quality, safety, or regulatory compliance.
All users remain fully responsible for compliance with local laws, advertising rules, and consumer regulations.

7. Verification, Audit & Revocation

7.1 PWC may request verification or audits at any time.

7.2 Certification may be immediately revoked for:

  • Fraud or misrepresentation

  • Non-payment

  • Reputational risk

  • Breach of these Terms

7.3 Upon revocation, all PWC Assets must be removed within 48 hours.

7A. Complimentary vs Paid Certifications

7A.1 Complimentary certifications have no monetary value and remain fully subject to these Terms.

7A.2 Paid certifications are non-refundable once verification begins.

7A.3 All certifications grant the same limited license. No enhanced rights apply.

8. Fees & Taxes

All fees are exclusive of applicable taxes unless stated otherwise.
Re-verification, re-issuance, or enforcement actions may incur additional fees.

9. Data & Privacy

PWC processes data solely for certification, verification, enforcement, and communication purposes, in accordance with applicable privacy laws.

10. Enforcement & Liquidated Damages

To protect the integrity of the Premium Water Certified™ mark, PWC enforces strict penalties.

10.1 Unauthorized Use

Minimum liquidated damages of €25,000 per violation, per badge, per location.

10.2 Continued Misuse

An additional €10,000 per day until full removal.

10.3 Repeat or Severe Violations

Up to €50,000 per violation, permanent blacklisting, and legal action.

10.4 Nature of Penalties

All penalties constitute reasonable liquidated damages, reflecting brand harm, enforcement costs, and reputational loss.

10.5 Additional Remedies

PWC may seek:

  • Injunctions

  • Takedowns

  • Public delisting

  • Recovery of legal and enforcement costs

  • Action in any competent jurisdiction

11. Misrepresentation of Certification

Misuse of the PWC seal constitutes false advertising, trademark infringement, and may result in civil and criminal liability.

12. Limitation of Liability

To the maximum extent permitted by law, PWC is not liable for indirect, incidental, or consequential damages.

Total liability is limited to fees paid in the preceding 12 months, except in cases of willful misconduct.

13. Indemnification

You agree to indemnify and hold harmless PWC from all claims, damages, costs, and expenses arising from your breach or misuse of PWC Assets.

14. Term & Termination

Certification remains valid only while compliance is maintained.
Termination may occur immediately upon breach.

15. Governing Law & Jurisdiction

These Terms are governed by the laws of The Netherlands.
Exclusive jurisdiction lies with the District Court of Amsterdam, without prejudice to PWC’s right to seek relief elsewhere.

16. Miscellaneous

No assignment without written consent.
Invalid provisions do not affect the remainder.
Failure to enforce does not constitute waiver.
Continued use constitutes acceptance of revised Terms.
