By visiting this website, purchasing a certification, or using any Premium Water Certified™ (“PWC”) badge, logo, image, file, document, or other brand asset (collectively the “PWC Assets”), you agree to be legally bound by these Terms & Conditions (“Terms”).
These Terms apply worldwide to any person or entity engaging with the PWC program for any commercial, promotional, or operational purpose.
1. Definitions

PWC – Premium Water Certified™, its owners, affiliates, officers, employees, and authorized representatives.

PWC Assets – All badges, logos, graphics, templates, texts, visuals, and promotional materials owned by PWC.

Certified Property – A property officially approved and listed as certified by PWC.

Approved Systems – Enagic® K8 Water Ionizer and/or Anespa DX Shower System, or any other system expressly approved by PWC.

Distributor – Any person or entity promoting or selling Enagic® systems or PWC certifications.
-
Certification Fee – The one-time fee charged by PWC for each issued certification per approved property.
2. Intellectual Property & Ownership
2.1 All intellectual-property rights in the PWC name, marks, logos, badges, and materials belong exclusively to PWC.
2.2 Certification does not grant ownership or transfer of any trademark, copyright, or design right.
2.3 Certified Properties receive a limited, non-exclusive, non-transferable, revocable license to display their assigned badge solely for the approved location.
2.4 Alteration, duplication, redistribution, or resale of PWC Assets without written authorization is strictly prohibited and may trigger enforcement under Section 10.
3. Certification Terms (For Property Owners & Operators)
3.1 Eligibility. Certification requires installation of at least one functional Approved System, submission of a complete application with proof of installation, and full payment of the Certification Fee (unless granted complimentary under Section 7A).
3.2 Scope of Benefits. Certified Properties receive:
• A personalized digital badge (Drinking Water / Shower Water / Gold).
• Permission to use approved digital materials for marketing.
• Optional listing on premiumwatercertified.com.
3.3 Location-Specific License. Certification is granted per public property listing or address (e.g., one villa, hotel, spa, or resort brand page). Badges may not be transferred to other addresses or brands.
3.4 Multi-Unit / Resort Rule. For resorts, hotels, or estates operating under one name and marketed as a single property (e.g., several villas within one resort), one certification covers all units on that site. If the same owner or group installs Approved Systems at different addresses or listings under different names, each must be registered and certified separately. Using a PWC badge for any non-registered property is unauthorized use (see Section 10).
3.5 Responsibilities. Owners must maintain their systems, comply with local laws, and use the badge truthfully. PWC is a private third-party marketing label and does not represent government or medical authorities.
4. Distributor & Representative Terms
4.1 Distributors may use PWC materials only for legitimate sales leading to certified installations and after written authorization.
4.2 They must report all installations by repeat clients or owners with multiple properties.
4.3 Prohibited actions include advertising as “Certified” before approval or payment, sharing or altering badge files, and making medical claims.
4.4 Distributors must inform clients that each property requires its own certification and badge.
4A. Distributor Compensation & Procedures
4A.1 Independent Status. Distributors are independent contractors, not employees or agents of PWC.
4A.2 Certification Eligibility. Certification may only be issued after purchase of authentic Enagic® equipment through an approved Distributor and submission of a verified application.
4A.3 Commission Eligibility. Distributors may qualify for a referral or commission on paid certifications in accordance with future PWC policies. All amounts and timing are at PWC’s sole discretion and depend on verified documentation of the originating sale and successful certification.
4A.4 Future Program. PWC may launch a formal Distributor / Affiliate Program. Until then, no commission is guaranteed or accrued without a signed agreement.
4A.5 Compliance. Distributors must represent PWC accurately and ethically. Any misleading conduct voids commission eligibility and may result in suspension or ban from the program.
5. Unauthorized Use & Fraudulent Representation
Any display, download, reproduction, or public use of a PWC badge without authorization is Fraudulent Representation. Examples include copying a badge from PWC channels and using it on Airbnb, Booking.com, or Google Maps.
Violations may result in:

Immediate cease-and-desist orders and takedowns.

Blacklisting and public delisting.
-
Liquidated damages starting at €25 000 per use plus €10 000 per day of continued misuse.

Reporting to Enagic®, OTAs, and authorities.
-
Criminal complaints for forgery or false advertising.
6. Health & Legal Compliance
PWC makes no medical or health claims. Users must comply with advertising, consumer-protection, and water-safety laws. Enagic® is independent and not responsible for this certification.
7. Verification & Revocation
PWC may request proof of installation or maintenance at any time and may revoke certification immediately for fraud, non-payment, or reputational risk. Upon revocation, all PWC Assets must be removed within 48 hours.
7A. Complimentary vs. Paid Certifications
7A.1 Complimentary (Free) Certifications. Properties purchasing Approved Systems through the PWC affiliate structure may receive their certification and badge free of charge as a promotional benefit. These badges have no cash value and remain subject to all other Terms.
7A.2 Paid Certifications (Existing Equipment Owners). Owners with pre-existing Enagic® units purchased outside the PWC network must submit a paid application and proof of authentic installation to obtain certification.
7A.3 Verification Requirement. All applicants (free or paid) must provide adequate proof (invoices, photos, serial numbers). PWC may deny applications with incomplete or fraudulent information.
7A.4 Non-Refundable / Non-Transferable. Complimentary certifications cannot be converted to cash or refunded. Paid certifications are non-refundable once review has begun.
7A.5 Equal Scope of Rights. Both free and paid certifications grant the same limited, non-transferable license for the approved property. All misuse remains subject to Section 10 penalties.
8. Fees & Refunds
All Certification Fees are non-refundable once the verification process has started. Taxes (VAT / GST) may apply. Additional fees may be charged for re-verification or re-issuance.
9. Data & Privacy
PWC processes application data solely for certification and communication purposes in line with applicable privacy laws. By applying, you consent to this processing.
10. Enforcement & Penalties
To protect the integrity and exclusivity of the Premium Water Certified™ mark, PWC enforces a strict system of liquidated damages and penalties for any misuse or breach of these Terms.
Any violation of the rules regarding use of the PWC badge, name, or materials may result in immediate suspension, blacklisting, and financial penalties, as outlined below.
10.1 Unauthorized Use (First Offense).
If any individual or business publicly displays, reproduces, or distributes a PWC badge or logo without authorization, PWC may impose a minimum fine of twenty-five thousand euros (€25,000) for each instance of misuse. In addition, the offending content must be removed immediately upon notice. PWC reserves the right to publish a public delisting notice and to block the party from future participation.
10.2 Repeat Offenses.
If a person or entity commits a second or subsequent violation within a period of twenty-four (24) months, each additional violation may result in a fine of fifty thousand euros (€50,000) per incident and a permanent ban from the Premium Water Certified™ program.
10.3 Unreported Installations.
If a property owner or distributor installs Enagic® systems at another location or address under the same ownership or brand but fails to register those installations with PWC, this constitutes an unreported installation. In such cases, PWC may charge a penalty of ten thousand euros (€10,000) or fifty percent (50%) of the retail value of each unreported unit, whichever amount is higher. The owner may also be required to pay a retroactive certification fee for each unregistered location.
10.4 Continued Misuse After Warning.
If an unauthorized use continues after a written warning or official takedown request from PWC, the violating party may be fined an additional ten thousand euros (€10,000) per day until the unauthorized use has been fully removed. PWC may also pursue an injunction and recovery of all profits obtained through the misuse.
10.5 Unauthorized Distribution of Badge Files.
Any person or company who shares, distributes, resells, or provides PWC badge files or visual assets to third parties without approval commits a serious breach of these Terms. Such conduct may result in a fine of fifty thousand euros (€50,000) per act and may trigger a criminal complaint for trademark infringement, forgery, or fraudulent representation.
10.6 Nature of the Penalties.
All penalties described in this section are considered liquidated damages — a reasonable pre-estimate of the losses, brand damage, and enforcement costs PWC incurs through misuse of its intellectual property. These penalties are cumulative, meaning PWC may apply more than one at the same time if multiple violations occur.
10.7 Additional Remedies.
In addition to monetary penalties, PWC reserves the right to seek injunctions, remove listings, demand written public retractions, recover legal fees and enforcement costs, and take legal action in any jurisdiction where the violation occurs.
11. Certification Seal Misrepresentation
The PWC badge is a protected certification mark. Misuse constitutes false advertising, unfair competition, and forgery and may lead to civil and criminal liability.
12. Limitation of Liability
To the maximum extent permitted by law, PWC is not liable for indirect or consequential damages, loss of income, or reputation. Total liability is limited to fees paid within the previous 12 months, except for willful misconduct.
13. Indemnification
You agree to indemnify and hold harmless PWC from all claims and expenses arising from your breach or unauthorized use of PWC Assets.

14. Term & Termination
Certification remains valid while Approved Systems are maintained and fees paid. PWC may terminate immediately for breach or fraud; upon termination all PWC Assets must be removed from public use.

15. Governing Law & Jurisdiction
These Terms are governed by the laws of The Netherlands. Exclusive jurisdiction lies with the District Court of Amsterdam, though PWC may seek injunctive relief in any competent court worldwide.

16. Miscellaneous
No assignment without written consent. If any provision is invalid, the remainder remains effective. These Terms form the entire agreement on certification and brand use. Failure to enforce is not a waiver. Continued use after updates means acceptance of revised Terms.

Badge & Brand Use Notice
Premium Water Certified™ badges, logos, and materials are protected by international trademark and copyright law.
Unauthorized use is strictly prohibited and subject to immediate takedown and fines up to €50 000 per violation.
Certified properties receive a limited, non-transferable license for the approved location only.
